Nepal started first experiments with democratic institutions after the downfall of the Rana system in 1951. The Interim Government of Nepal Act, the provisional constitution of 1951, had provided for elections to a Constituent Assembly to be held within two years. But this option was never realized due to the steady restoration of absolute royal powers forced by the Kings Tribhuvan and Mahendra. So, there was no Nepali parliament in the 1950s.
The Constitution of 1959 provided for a bicameral legislature: the Pratinidhi Sabha (House of Representatives) and the Mahasabha (Senate). The 109 members of the Pratinidhi Sabha became directly elected according to plurality system in single-member constituencies. The Mahasabha comprised 36 senators, half of them elected by the Pratinidhi Sabha, the other half nominated by the King. The members of the Pratinidhi Sabha had to be of at least 25 years of age, those of the Mahasabha of 30 years.
During Panchayat times (1961-1990), with political parties being outlawed, parliamentary democracy was more or less a farce. The legislature called Rastriya Panchayat (National Panchayat) was unicameral and formed of members elected by the Zonal Assemblies (Anchal Sabha), of representatives of the so-called class organizations and graduates, and persons nominated by the King.
There was a change to more democracy after the national referendum of 1980. Both the parliaments of 1981 and 1986 had 140 members. Of these 112 were directly elected in single-member constituencies on the basis of adult suffrage, the other 28 parliamentarians were nominated by the King. The Constitution now also provided for a council of ministers responsible to the Rastriya Panchayat. The King was to nominate the person commanding the majority support of the Parliament as Prime Minister.
After the people’s movement of 1990, a western-style democracy was introduced in Nepal. Nowadays, there are two Houses of Parliament, the Pratinidhi Sabha (House of Representatives) and the Rastriya Sabha (National Assembly). The Pratinidhi Sabha has 205 members directly elected for a term of five years. By-elections take place if an MP dies or if an MP has been elected from more than one constituency. An Anti-Defection law went into effect in October 1997 to prevent the frequent party defections. It requires the backing of at least 40 percent of the parliamentary party in case of party splitting. Else the defecting MPs will loose their mandate.
The Rastriya Sabha is a permanent House. The tenure of office of its 60 members is six years with one third expiring every two years. 35 of its members, including at least three women members, are elected by the Pratinidhi Sabha by single-transferable vote. 15 members, three from each of the five Development Regions, are elected by an electoral college consisting of the Chief (Pramukh) and Deputy Chief (Upapramukh) of the local authorities and the Chief, Deputy Chief and the members of the district authorities. Another ten members are nominated by the King from amongst persons of high reputation.
Usually, there are two sessions of parliament every year, summoned by the King.
With the dissolution of the House of Representatives in May 2002 and, as a logical consequence, not possible by-elections to the National Assembly in mid 2003, Nepal does no longer have a parliament. All power was back in the hands of the king as it was during Panchayat times, but this time without the backing of the constitution. The House became reinstated on April 24, 2006, after a second people's movement.
This parliament was again dissolved on January 15, 2007, after promulgating the interim constitution. A new interim parliament became installed on the same day with all members nominated by the leaders of the political parties who once again failed to make this interim parliament inclusive because they re-nominated all members of the non-inclusive previous parliament.
